Our directors have represented a diverse range of clients; some recent projects are outlined below.
NSEL has a great deal of experience representing a wide variety of water users including diary farmers, irrigators, the mining industry, tourism operators and hydroelectric generators.The increased commercial demands that have been placed on New Zealand's water resources means that obtaining water allocation is now an extremely competitive exercise. The different range of water users also means that water diversion and discharges can face stiff opposition.NSEL has a proven track record in securing approvals for water allocation, diversion and discharge. Examples of projects include:
NSEL has recently been engaged to obtain a suite of consents from ECAN for the construction of a dam for the purpose of providing up to 3 million cubic metres of water storage for irrigation activities.
Secured various water permits for Foveran and Winterberg Farms including consent to take surface water at a rate of 320 l/s for spray irrigation, construct a 28 metre high dam and dam up to 5.5 million cubic metres of water by way of water harvesting. The conditions of the water harvesting permits were appealed on the basis of flow sharing requirements. The appeal was successfully resolved without the need to go to court.
Appeared before Commissioner Skelton (former Environment Court Judge) together with Royden Somerville QC on behalf of irrigation applicants seeking priority over Meridian Energy Limited's application for water allocation from the Waitaki River. Commissioner Skelton's priority decision confirmed that many of the irrigation applications had priority over Meridian's North Bank Tunnel project.

A particular strength is that NSEL remain focused on the client's desired outcomes when matters proceed to local authority hearings or the Environment Court. The MOE was concerned about the adverse effects the construction and operation of the motorway connection would have on Waterview Primary School. NSEL prepared the school's case, negotiated mitigation measures, drafted a settlement agreement and represented the MOE at the hearing.

NSEL Director, Robert Makgill, appeared as legal counsel for the International Union for Conservation of Nature in the International Law for the Sea Tribunal deep sea mining proceedings in Hamburg, Germany, 2010. We have provided advice to the Parliamentary Commissioner for the Environment, the mining industry, the deep sea mining industry and inter-governmental organisations.

North South Environmental Law, Resource management, Legal services - coastal marine

Prepared legal advice for Local Government New Zealand on the implications of the Marine and Coastal Area Bill for the administration of the coastal marine area by regional councils under the Resource Management Act 1991. Advised the International Union for Conservation of Nature on provision under Fijian legislation for integrated coastal management and provided recommendations for legislative amendments and improved decision making.

Defended Southern LC Limited against an application for ex parte interim enforcement orders by Queenstown Lakes District Council to cease operation of a cement works until noise levels abated. NSEL is very experienced at defending criminal prosecutions and applications for enforcement orders under the Resource Management Act 1991.
