ACPI’s Compliance Officer is responsible for ensuring we comply with all federal, state, and local laws and regulations. We continually review and update company policies and procedures to meet new requirements, and we regularly participate in continuing education programs to stay abreast of changes on the law.
ACPI maintains full compliance with laws and regulations that include, but are not limited to, the following:
- Fair Credit Reporting Act (FCRA)
- Fair Debt Collection Practices Act (FDCPA)
- Gramm-Leach-Bliley Act (GLBA)
- Health Insurance Portability and Accountability Act (HIPAA)
- Minnesota Attorney General Hospital Agreement
ACPI works diligently to collect your accounts. When it is determined that your customers are not willing to cooperate in resolving their debt, we will request written authorization from you to persue legal action on your behalf. This authorization also allows ACPI to be your agent to remit proceeds and forward correspondence from the attorney. Legal/Forwarded rates apply to any funds collected from this point on.
There are also times when your customer may move out of the area. In that event we would forward their account to a collection agency in their local area. This is done only after we have determined that an agency in that area would be better able to obtain pertinent information on your customer. We only work with licensed collection agencies that accept forwarded accounts. Legal/Forwarded fees apply to any funds collected from this point on.
We can find almost anyone in a matter of seconds and even obtain their date of birth, social security number and other vital information that helps us to locate the debtor. We perform skip-tracing on a daily basis on collection files that are placed with our firm and the costs are not passed onto you. It is simply the cost of doing business for our firm. In order to collect effectively, skip-tracing and investigations are always necessary. We can not stress enough the importance of getting good and current information about your account holders. However, the mobility of the debtor population makes skip tracing expertise a critical factor in effectively collecting accounts. Our goal is to persistently piece together more and more information in order to zero in on where the debtor lives, works and where his/her assets are located. To accomplish our goals, we utilize a number of proven tools:
- National Change of Address (NCOA)
- Public and private address and phone number search forms and sources
- National Credit Bureaus
- Departments of Motor Vehicles (DMV)
- Creditors, references, neighbors, etc.
ACPI has invested deeply in technology and process improvement to facilitate seamless integration with our clients’ operations.
